Terms of Service

1. Acceptance of Terms

By accessing or using DeployGuard's services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

DeployGuard provides a Kubernetes deployment failure detection service. The Service includes:

  • A control plane for managing clusters and viewing failures
  • An agent that runs in your Kubernetes clusters
  • Notification delivery (Slack, webhook, email)
  • API access for programmatic integration

3. Account Registration

To use the Service, you must register for an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access
  • Accept responsibility for all activities under your account

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Reverse engineer or decompile the Service
  • Resell or redistribute the Service without authorization
  • Send false or misleading failure signals

5. Agent Installation

By installing the DeployGuard agent in your Kubernetes cluster, you acknowledge that:

  • The agent requires read-only access to pods, deployments, and events
  • The agent sends failure data to our control plane
  • You are authorized to install software in the cluster
  • You are responsible for uninstalling the agent when no longer needed

6. Payment and Billing

For paid plans:

  • Fees are billed monthly or annually in advance
  • All fees are non-refundable unless otherwise stated
  • We may change pricing with 30 days notice
  • Failure to pay may result in service suspension

7. Service Level Agreement

For Team and Enterprise plans, we commit to 99.9% uptime for the control plane. This SLA does not cover:

  • Scheduled maintenance (with 24-hour notice)
  • Issues with your Kubernetes clusters or network
  • Force majeure events

8. Intellectual Property

The Service, including all software, documentation, and content, is owned by DeployGuard and protected by intellectual property laws. You receive a limited, non-exclusive license to use the Service according to these Terms.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL DETECT ALL FAILURES OR BE ERROR-FREE. YOU USE THE SERVICE AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEPLOYGUARD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

11. Termination

Either party may terminate this agreement at any time. Upon termination:

  • Your access to the Service will be revoked
  • You must uninstall all agents from your clusters
  • We will delete your data according to our Privacy Policy

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which DeployGuard is incorporated, without regard to conflict of law principles.
